Terms of purchase
The Hearing Shop’s terms and conditions of supply
Any order and subsequent purchase of goods (as defined below) or services from The Hearing Shop shall be governed by the following terms and conditions. Please read them carefully.
These terms and conditions do not affect your statutory rights as a consumer.
1. Customer obligations
By submitting your order to The Hearing Shop, you confirm:
• You are aged 18 or over;
• You have had a hearing assessment within the past 6 months, which included case history, otoscopy and hearing test.
• You are aware that you are purchasing hearing aids which will be programmed to your audiogram, with no in-person appointment.
• You have to submit a valid audiogram to us before your hearing aid purchase is accepted.
•You are also stating that the reason for purchasing these hearing aids from The Hearing Shop is for the sole purpose of personal use only
2. Orders for goods
Orders placed with The Hearing Shop must be made either through the website at www.hearingshop.co.uk or by contacting us via telephone at 0808 208 5154
The act of submitting an order constitutes an offer to procure goods from The Hearing Shop, and we may acknowledge the receipt of this offer either through email (if the order is placed via the website) or verbally (if the order is placed via telephone).
For hearing aid orders, our acceptance occurs once your payment is processed, and the order is reviewed and authorised by our in-house audiologist.
Confirmation of the acceptance of your order will be provided via email or verbally.
3. Limitations of supply
We will make every effort to ensure the hearing aids you have ordered are fulfilled; however, in very rare circumstances, as we rely on our manufacturers, we cannot guarantee the availability of goods.
If the Goods you have ordered have become unavailable, we will firstly discuss the options with the manufacturer in question, ascertain the reasonable timescales for delivery and communicate that to you whilst also giving you a choice to receive an alternative hearing aid or a refund.
If we are unable to contact you, your order will be cancelled automatically, and a full refund will be issued.
On the advice of our in-house Audiologist, we have sole discretion as to whether or not to accept your hearing aid Order. The Hearing Shop audiologists have absolute discretion:
• To request that you send us a copy of your latest audiogram.
• To contact directly, or request that you contact, the audiologist who provided your audiogram to verify and/or discuss your hearing test results;
If, following your order, any member of The Hearing Shop team requests further information from you and they have not supplied to us or attempts to contact you, and you have received no reply within 30 days, your hearing aid order will be cancelled and refunded.
4. Prices and payment
We will be meticulous in ensuring the accuracy of the prices of hearing aids on the website. The price you pay is a retail price as appearing in your basket and is inclusive of any Value Added Tax (VAT).
However, we cannot guarantee that we will not make a mistake and misprice an item unintentionally. If this is the situation, the audiologist reviewing and authorising your order will contact you to explain the error.
You will then have the choice to either accept the correct price or to cancel your order.

Changes to the website
The Hearing Shop retains the right to terminate, modify, suspend, or discontinue any aspect of the website at its discretion. This includes the ability to impose limitations on specific features and services and/or restrict access to parts or the entirety of the website without prior notice or liability.
The Hearing Shop reserves the right to terminate and or suspend your login and access to the secure areas of the website should our terms of use be breached.
No waiver
No waiver by The Hearing Shop of any breach of any obligation arising under these Terms of Use shall be deemed a waiver of any other breach.
Furthermore, the failure to exercise or partially exercise any remedy by The Hearing Shop shall not constitute a waiver of the right to subsequently exercise that or any other remedy.
Governing law and jurisdiction
The Terms of Use of the website shall be governed by and interpreted in accordance with the laws of England. The courts of England shall have exclusive jurisdiction to settle any disputes arising out of or in connection with the use of the website.
Severability
If any provision of these Terms of Use is deemed illegal, invalid, or unenforceable under the laws of any jurisdiction where these Terms of Use are intended to be effective, it shall be severed and deleted to the extent of its illegality, invalidity, or unenforceability within that jurisdiction.
The remaining Terms of Use shall endure, remain in full force and effect, and continue to be binding and enforceable.
